Driver Partner Agreement

This Driver Partner Agreement (“Agreement”) sets forth the terms and conditions governing the relationship between Modi Enterprises, the operator of the Namma Electric Platform, and individuals who register as driver partners to provide transportation services through the Platform.
By registering as a driver partner and using the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement.
1. Nature of Relationship
The Platform operates as a technology-based marketplace connecting customers seeking transportation services with independent driver partners.
By entering into this Agreement, the driver partner acknowledges and agrees that:
• the Company does not employ driver partners
• driver partners operate as independent service providers
• the Company does not control the manner in which rides are performed
• this Agreement does not create any employer–employee, partnership, or joint venture relationship
Driver partners are solely responsible for providing transportation services using their own vehicle.
2. Driver Eligibility
To register as a driver partner on the Platform, an individual must meet the following minimum eligibility requirements:
• possess a valid driving license issued by the appropriate authority
• be legally permitted to operate the vehicle category used for rides
• provide valid government-issued identification for verification
• submit complete and accurate registration information
• comply with applicable transport regulations and local laws
The Company reserves the right to verify documents and approve or reject any driver application at its discretion.
3. Driver Registration
To activate an account on the Platform, the driver must complete the registration process and submit the required documentation.
This may include:
• valid driving license
• vehicle registration certificate (RC)
• valid motor vehicle insurance
• pollution under control certificate (PUC)
• government identity proof (such as Aadhaar or PAN)
• bank account details for payment settlements
• recent photograph of the driver and vehicle (if required)
The Company may conduct document verification or background checks to ensure compliance with platform safety standards.
4. Driver Responsibilities
Driver partners agree to perform their services responsibly and professionally.
Drivers must:
• maintain a roadworthy, safe, and properly maintained vehicle
• comply with all applicable traffic and transport laws
• ensure cleanliness and proper condition of the vehicle
• behave respectfully and professionally toward customers
• provide safe and reliable transportation services
• avoid any form of harassment, discrimination, or misconduct
Drivers must not:
• operate a vehicle under the influence of alcohol or drugs
• engage in unsafe or reckless driving
• carry illegal goods or substances
• misuse the Platform or manipulate ride requests
Failure to comply with these responsibilities may result in suspension or termination of the driver’s account.
5. Subscription Charges
To receive ride requests through the Platform, driver partners must maintain an active subscription plan.
The available subscription plans include:
Daily Plan
₹35 per day + applicable GST
Monthly Plan
₹999 per month + applicable GST
Important conditions:
• drivers must maintain an active recharge to access ride requests
• subscription fees are non-refundable once activated
• expired subscriptions will temporarily disable ride requests
• the Company reserves the right to revise subscription pricing or introduce new plans
6. Platform Fees and Earnings Model
The Platform may charge certain service or platform-related fees from driver partners.
Depending on the operational model of the Platform:
• the driver may retain the majority of the ride fare
• the Platform may collect subscription fees, convenience fees, or other service charges
All applicable charges will be transparently displayed in the driver application or communicated through platform policies.
7. Payment Settlement
Driver partners will receive payments for completed rides through the methods supported by the Platform.
Payments may include:
• cash payments collected directly from customers
• digital payments processed through the Platform
For digital payments:
• settlements may be transferred to the driver’s registered bank account
• settlement timelines may vary depending on payment gateway processing and internal policies
Drivers are responsible for ensuring that their bank account details are accurate and up to date.
8. Ratings and Performance Monitoring
To maintain service quality, the Platform may allow customers to rate driver partners after each ride.
The Company may monitor:
• driver ratings
• cancellation behavior
• ride acceptance rates
• customer complaints or safety reports
Drivers with consistently poor performance or repeated complaints may be subject to warnings, suspension, or removal from the Platform.
9. Driver Suspension
The Company reserves the right to suspend or restrict driver accounts in situations including but not limited to:
• submission of false or misleading documents
• fraudulent activities or misuse of the Platform
• repeated ride cancellations
• unsafe driving behavior
• customer complaints or misconduct
• violation of this Agreement or other platform policies
Suspension may be temporary or permanent depending on the severity of the violation.
10. Insurance and Liability
Driver partners are responsible for maintaining valid vehicle insurance and complying with all legal requirements related to vehicle operation.
The Company does not provide transportation services and shall not be responsible for:
• vehicle accidents or damages
• injuries occurring during rides
• driver negligence or misconduct
• violations of traffic or transport laws
Driver partners assume full responsibility for their services and vehicle operation.
11. Taxes and Regulatory Compliance
Driver partners are responsible for complying with all applicable tax laws and regulatory requirements related to their earnings from the Platform.
This may include:
• income tax obligations
• GST compliance where applicable
• local transport regulations
The Company shall not be responsible for any tax liabilities incurred by driver partners.
12. Data and Platform Usage
Driver partners agree to use the Platform solely for legitimate ride service purposes.
Drivers must not:
• share account access with unauthorized persons
• manipulate ride requests or fares
• misuse customer contact information
• engage in any activity that compromises platform security
All data provided through the Platform must be handled responsibly and in accordance with the Platform’s Privacy Policy.
13. Agreement Termination
Either party may terminate this Agreement at any time.
The Company may terminate the driver’s access to the Platform in cases including:
• violation of this Agreement
• fraudulent activity
• repeated complaints or safety concerns
• legal or regulatory requirements
Upon termination:
• the driver will lose access to the Platform
• any pending payments may be processed subject to internal review
14. Modifications to Agreement
The Company reserves the right to modify or update this Agreement from time to time.
Updated versions will be published on the Platform.
Continued use of the Platform after such updates constitutes acceptance of the revised Agreement.
15. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising under this Agreement shall be subject to the jurisdiction of the courts located in Bengaluru, Karnataka.
