1. Introduction
Welcome to Namma Electric, a technology-enabled ride-booking platform owned and operated by Modi Enterprises (referred to as the “Company”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your access to and use of the Namma Electric mobile application, website, and any related services, features, or functionalities (collectively referred to as the “Platform” or “Service”).
By accessing, registering, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy and any additional guidelines or policies that may apply to specific services.
If you do not agree with any part of these Terms, you must refrain from accessing or using the Platform.
The Platform functions solely as a technology intermediary that enables customers to connect with independent driver partners for transportation services. The Company does not provide transportation services directly and is not a transportation carrier.
2. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:
Company - Refers to Modi Enterprises, the entity that owns, manages, and operates the Namma Electric Platform.
Platform / Service - Refers to the Namma Electric mobile application, website, and all associated services, features, and functionalities made available to users.
Customer / User - Any individual who accesses or uses the Platform to request transportation or ride-booking services.
Driver Partner / Service Provider - An independent individual registered on the Platform who provides transportation services using their own vehicle and operates as an independent contractor, not as an employee of the Company.
Ride - A transportation service requested by a Customer through the Platform and accepted by a Driver Partner.
Vehicle - Any two-wheeler, three-wheeler, car, electric vehicle, or other authorized transport vehicle used by a Driver Partner to provide ride services through the Platform.
Device - Any smartphone, tablet, computer, or electronic device capable of accessing the Platform.
Force Majeure Event - Any event beyond the reasonable control of the Company including, but not limited to, natural disasters, floods, earthquakes, strikes, riots, war, government actions, pandemics, severe weather conditions, fuel shortages, or system/network failures.
3. Nature of the Platform
Namma Electric operates as a technology platform that facilitates connections between customers seeking transportation services and independent driver partners who provide such services.
The Company:
• does not own or operate transportation vehicles
• does not employ drivers as employees or agents
• does not directly provide transportation services
All transportation services available through the Platform are provided by independent driver partners, who are solely responsible for the operation of their vehicles and the services they offer to customers.
The role of the Company is limited to providing the digital infrastructure that enables ride booking, communication, and payment facilitation between customers and driver partners.
Accordingly, the Company shall not be held responsible for the conduct, actions, or services provided by driver partners during a ride.
4. Eligibility
To access or use the Namma Electric Platform, users must meet the following eligibility requirements:
• You must be at least 18 years of age.
• You must have the legal capacity to enter into a binding agreement under applicable laws.
• You must provide true, accurate, and complete registration information when creating an account or using the Platform.
By accessing or using the Platform, you represent and warrant that you meet the above eligibility criteria.
Users are responsible for ensuring that their use of the Platform complies with all applicable laws, regulations, and governmental requirements in India.
The Company reserves the right to restrict, suspend, or terminate access to the Platform if it determines that a user does not meet the eligibility requirements or violates applicable laws.
5. Registration and Account
In order to access certain features of the Platform, users may be required to register and create an account.
When creating an account, you agree to:
• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and up to date.
• Maintain the confidentiality and security of your login credentials.
• Notify the Company immediately if you become aware of any unauthorized use or security breach involving your account.
You are solely responsible for all activities conducted through your account, whether or not such activities are authorized by you.
The Company reserves the right to suspend, restrict, or terminate accounts that contain false, misleading, incomplete, or fraudulent information.
5.1 Correct Application Version
Users are responsible for downloading the correct version of the Namma Electric application compatible with their device.
Modi Enterprises shall not be liable if a user:
• downloads an incorrect version of the application
• uses an unsupported device
• experiences issues due to device incompatibility
The Company reserves the right to terminate access to the Platform if the Service is used through unauthorized or incompatible devices.
5.2 Identity Verification
The Company may require users or driver partners to submit additional identity verification documents including government identification, address proof, or other documents to ensure safety and compliance.
Failure to provide requested verification may result in:
• suspension of account
• restriction of services
• permanent termination from the Platform
5.3 Single Account Policy
Users are permitted to create only one account using their personal details.
Creation of multiple accounts for fraudulent activities, misuse of promotions, or bypassing restrictions may lead to:
• suspension of accounts
• permanent ban from the Platform.
6. Driver Partner Registration
Individuals who wish to provide transportation services through the Platform must complete the Driver Partner registration process and submit the required documentation.
Required documents may include, but are not limited to:
• Valid Driving License
• Vehicle Registration Certificate (RC)
• Valid Vehicle Insurance
• Pollution Under Control (PUC) Certificate
• Government-issued identity proof
• Bank account details for payment settlements
The Company reserves the right to approve, reject, or suspend driver registrations based on its internal verification procedures, safety policies, or regulatory requirements.
Driver partners are solely responsible for ensuring that their vehicle:
• is legally registered and permitted for transportation services
• is roadworthy, safe, and well maintained
• complies with all applicable transportation and traffic laws.
7. Driver Subscription & Recharge Policy
To receive ride requests on the Platform, driver partners must maintain an active subscription.
Available subscription plans:
Daily Plan:
₹35 per day + applicable GST
Monthly Plan:
₹999 per month + applicable GST
Important Conditions:
• Drivers must maintain an active recharge or subscription in order to receive ride booking requests.
• Subscription charges are non-refundable once activated.
• If a subscription expires or remains unpaid, the driver will temporarily lose access to ride requests until the subscription is renewed.
• The Company reserves the right to revise, modify, or introduce new subscription plans, pricing structures, or policies at its sole discretion.
Continued use of the Platform by driver partners after such changes will constitute acceptance of the updated subscription terms.
8. Ride Booking Process
Customers may request a ride through the Platform by entering the required trip details, including the pickup location and destination.
Once a ride request is submitted:
• the request may be made available to nearby driver partners a driver partner may choose to accept or reject the ride request
• If a driver partner accepts the booking, the Platform may display relevant trip and driver details to the customer, including:
• driver partner’s name
• vehicle registration number
• contact details, where applicable
• estimated time of arrival
The Company does not guarantee that every ride request will be accepted by a driver partner or that a driver partner will be available at all times.
Ride availability may depend on several factors, including driver availability, location, weather conditions, technical issues, and demand on the Platform.
9. OTP Verification
For safety and verification purposes, each ride may be initiated only after successful OTP verification.
At the start of the ride:
• the customer must provide the One Time Password (OTP) generated in the application to the driver partner
• the driver partner must enter the OTP in the Platform before commencing the trip
The OTP serves as a ride authentication and security mechanism to confirm that the correct customer has boarded the correct vehicle.
If the OTP is not provided or verified successfully, the ride may not be started, and the Company shall not be responsible for any delay, inconvenience, or failed trip arising from such non-verification.
Customers are advised not to share the OTP before boarding the vehicle.
10. Fare Estimation & Payments
The Platform may provide an estimated fare before confirmation of the ride. Such estimate is indicative only and may be based on factors including:
• pickup and destination locations
• estimated distance
• expected trip duration
• traffic conditions
• demand and supply conditions
• tolls, fees, or other applicable charges
The final fare charged may differ from the estimated fare depending on the actual route taken, waiting time, traffic conditions, ride duration, detours, tolls, or any other applicable factors.
Payments for rides may be made through the payment methods made available on the Platform, including:
• Cash
• UPI
• online payment gateways
• any other authorized digital payment methods introduced by the Company from time to time
The customer agrees to pay all applicable charges associated with the ride, including:
• base fare
• distance-based or time-based charges
• waiting charges, if applicable
• tolls and statutory levies
• platform fees or convenience fees, where applicable
• taxes, including applicable GST
The Company reserves the right to revise fare structures, pricing methods, platform charges, or payment options at its discretion.
11. Ride Cancellation Policy
11.1 Customer Cancellation
Customers may cancel a ride request through the Platform before or after a driver partner accepts the booking.
However, cancellation charges may apply in certain situations, including but not limited to:
• where the driver partner has already arrived at the pickup location
• where the driver partner has traveled a reasonable distance toward the pickup point
• where the trip has already been initiated
Any applicable cancellation charges shall be communicated through the Platform and may be added to the customer’s payable amount.
Frequent or abusive cancellations by a customer may result in temporary restriction, suspension, or termination of access to the Platform.
11.2 Driver Partner Cancellation
Driver partners are expected to honor ride requests once accepted, except in genuine and unavoidable circumstances.
Repeated, unjustified, or excessive cancellations by a driver partner may result in disciplinary action, including:
• warnings
• temporary suspension from receiving ride requests
• permanent removal or deactivation from the Platform
The Company reserves the right to monitor cancellation patterns and take appropriate action in order to maintain service quality and platform reliability.
12. Promotions and Campaigns
The Platform may, from time to time, offer promotional discounts, referral rewards, coupons, cashback offers, or special marketing campaigns to customers or driver partners.
Such promotions:
• may be subject to separate terms and conditions
• may be valid only for a limited period or specific users
• may be modified, suspended, or withdrawn at any time without prior notice
• may not be combined with other offers unless expressly stated otherwise
The Company reserves the right to determine eligibility for any promotion and to withhold, cancel, or recover promotional benefits in cases of misuse, fraud, abuse, or violation of applicable terms.
In the event of any conflict between these Terms and the terms applicable to a specific promotion or campaign, the promotion-specific terms shall prevail to the extent of such conflict.
13. Refund Policy
Refunds may be issued in limited circumstances, including but not limited to:
• duplicate payment transactions
• failed or incomplete payment transactions
• cancelled rides where payment has been successfully deducted from the customer
• any other case where the Company determines that a refund is reasonably justified
All refund requests shall be subject to review and verification by the Company.
The Company reserves the right to:
• approve or reject any refund request based on its internal verification process
• request supporting details or proof relating to the transaction
• determine the eligible refund amount, whether full or partial, depending on the circumstances
Approved refunds shall be processed within a reasonable period through the original payment method or any other method deemed appropriate by the Company, subject to applicable banking or payment gateway timelines.
The Company shall not be liable for delays caused by banks, payment gateways, UPI platforms, or other third-party payment service providers.
Refunds shall not be granted for reasons arising from user error, incorrect booking details, failure to board, or dissatisfaction with estimated timings, unless otherwise determined by the Company at its sole discretion.
14. User Conduct
Users are expected to use the Platform in a lawful, respectful, and responsible manner.
By using the Platform, users agree that they shall not:
• provide false, inaccurate, misleading, or incomplete information
• impersonate another person or create accounts using unauthorized details
• harass, abuse, threaten, intimidate, or behave offensively toward driver partners,
• customers, support staff, or any other person
• damage, misuse, or tamper with any vehicle, device, property, or Platform infrastructure
• carry or transport any illegal, hazardous, prohibited, or unauthorized items
• engage in unlawful, fraudulent, or criminal activity while using the Platform
• interfere with the proper functioning of the Platform or attempt unauthorized access to any account, system, or network
• use the Platform in a manner that may endanger the safety, rights, or well-being of others
Any violation of this clause may result in immediate action by the Company, including:
• warning notices
• temporary suspension of account
• permanent termination of access to the Platform
• reporting to law enforcement or relevant authorities, where required
The Company reserves the right to investigate complaints, monitor misuse, and take appropriate action to protect the Platform, its users, and driver partners.
15. Driver Responsibilities
Driver partners using the Platform agree to comply with all applicable legal, operational, and safety requirements.
Driver partners shall be responsible for:
• maintaining valid driving licenses, permits, registrations, insurance, and all other legally required documents
• complying with all applicable traffic laws, transport regulations, and government requirements
• ensuring that the vehicle used for providing rides is clean, safe, roadworthy, and properly maintained
• behaving professionally, respectfully, and courteously toward customers at all times
• arriving at pickup locations within a reasonable time, subject to traffic, weather, and practical conditions
• not operating the vehicle under the influence of alcohol, drugs, or any substance that may impair driving ability
• ensuring the safety and lawful conduct of rides undertaken through the Platform
Driver partners acknowledge and agree that they are solely responsible for:
• the operation, condition, and maintenance of their vehicle
• the transportation services provided by them
• compliance with all legal obligations applicable to them as independent service providers
The Company shall not be responsible for the acts, omissions, negligence, misconduct, or legal violations of any driver partner in the course of providing transportation services.
16. Intellectual Property
All rights, title, and interest in and to the Platform, including but not limited to its:
• software
• source code and technology
• design and layout
• logos and trade names
• trademarks and branding elements
• text, graphics, images, content, and other materials
shall remain the exclusive property of Modi Enterprises and/or its licensors, as applicable.
Users are granted a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform solely for its intended purpose in accordance with these Terms.
Users shall not, without prior written consent of the Company:
• exploit any part of the Platform or its content
• reverse engineer, decompile, disassemble, or attempt to extract the source code of the Platform
• use any trademarks, logos, brand names, or other intellectual property belonging to the Company in any manner not expressly permitted
Unauthorized use of the Platform or its intellectual property may result in legal action under applicable laws.
17. Third-Party Services and External Links
The Platform may contain or integrate with third-party websites, applications, payment gateways, mapping services, communication tools, analytics providers, or other external services.
The Company does not own, control, endorse, or assume responsibility for any third-party services, including their:
• content
• accuracy
• availability
• privacy
• practices
• terms of use
Any access to or use of third-party services shall be at the user’s own risk and subject to the applicable terms and policies of such third parties.
The Company shall not be liable for any loss, damage, delay, or issue arising from the use of or reliance on any third-party website, service, or platform.
Users are encouraged to review the terms of service and privacy policies of any third-party websites or services they access through the Platform.
17.1 Analytics and Usage Monitoring
The Company may use internal tools and third-party analytics services to monitor, measure, and analyze usage of the Platform for legitimate business and operational purposes, including:
• improving platform performance and functionality
• detecting fraud, abuse, or suspicious activity
• enhancing user experience and service efficiency
• understanding usage patterns and customer behavior
• maintaining security and operational reliability
Such analytics tools may collect technical, device-related, and usage-related information, including anonymized or aggregated data, in accordance with the Company’s Privacy Policy.
By using the Platform, users consent to such monitoring and analytics practices as permitted under applicable law and the Privacy Policy.
17.2 Feedback and Suggestions
Users may voluntarily submit feedback, suggestions, reviews, ideas, recommendations, or other comments regarding the Platform or its services.
By submitting any such feedback, the user agrees that:
• the Company may use, implement, copy, modify, publish, or otherwise exploit such feedback for any purpose
• such use may be made without notice, acknowledgment, or compensation to the user
• the user shall have no ownership, intellectual property claim, or other rights over improvements or changes developed using such feedback
This clause shall survive termination of the user’s relationship with the Platform.
18. Disclaimer of Warranties
The Platform is provided on an “as is”, “as available”, and “with all faults” basis, to the maximum extent permitted under applicable law.
The Company does not make any representation or warranty, express or implied, regarding:
• uninterrupted or continuous availability of the Platform
• error-free, secure, or virus-free operation
• accuracy, reliability, or completeness of any content or information on the Platform
• availability of driver partners at any particular time or location
• quality, suitability, safety, or timeliness of transportation services provided by driver partners
The Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and compatibility.
Use of the Platform is at the user’s sole risk.
19. Limitation of Liability
To the fullest extent permitted by applicable law, the Company, its owners, affiliates, officers, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with the use of, or inability to use, the Platform or services arranged through it.
Without limiting the above, the Company shall not be liable for:
• any act, omission, negligence, misconduct, or unlawful behavior of any driver partner or user
• the condition, safety, maintenance, or legality of any vehicle used by a driver partner
• accidents, injuries, losses, damages, or disputes arising during or in connection with a ride
• delays, cancellations, service interruptions, or non-availability caused by traffic, weather, technical issues, or other external factors
• loss of data, payment failures, unauthorized account access, or interruptions caused by third-party service providers
• disputes between customers and driver partners, including fare-related or conduct-related disputes
The Company’s role is limited to providing a technology platform that facilitates connections between customers and independent driver partners. The Company does not directly provide transportation services and shall not be treated as a transport operator, carrier, or employer of driver partners.
To the extent any liability is established notwithstanding the above, the Company’s aggregate liability shall not exceed the amount of platform fees, if any, paid by the user to the Company in relation to the specific transaction giving rise to the claim.
20. Account Suspension or Termination
The Company reserves the right, at its sole discretion, to suspend, restrict, deactivate, or terminate any user or driver partner account, with or without prior notice, if:
• these Terms or any applicable policy are violated
• fraudulent, unlawful, suspicious, or abusive activity is detected
• false, forged, misleading, or incomplete information or documents are submitted
• repeated complaints, misconduct reports, or safety concerns are received
• identity verification or compliance requirements are not fulfilled
• continued access to the Platform may create legal, operational, or safety risks
The Company may also remove access to certain features of the Platform pending investigation or resolution of any complaint, dispute, or policy violation.
Suspension or termination of an account shall not affect any rights, obligations, liabilities, or remedies that accrued prior to such suspension or termination.
The Company shall not be liable for any loss, inconvenience, or damage arising from suspension, restriction, or termination of access to the Platform in accordance with these Terms.
20.1 Account Blocking Request
If a user or driver partner believes that their account has been compromised, accessed without authorization, or used fraudulently, they must notify the Company immediately through the designated support channels.
Upon receiving such notice, the Company may, at its discretion and subject to verification, temporarily block, suspend, or restrict access to the account in order to prevent further unauthorized use.
The Company shall not be liable for:
• any unauthorized transactions, activity, or misuse occurring before the account blocking request is received and reasonably processed
• delays caused by incomplete information, verification requirements, or technical limitations in processing the request
Users are responsible for maintaining the confidentiality and security of their login credentials and device access at all times.
21. Force Majeure
The Company shall not be liable for any failure, interruption, delay, or inability to perform its obligations under these Terms where such failure or delay arises from events or circumstances beyond its reasonable control.
Such events may include, but are not limited to:
• natural disasters or acts of God
• floods, earthquakes, storms, fires, or other severe weather conditions
• war, riots, civil unrest, or acts of terrorism
• strikes, lockouts, labor disputes, or industrial actions
• government actions, regulatory restrictions, or court orders
• epidemic, pandemic, public health emergencies, or lockdowns
• power outages, network disruptions, server failures, or technical breakdowns
• failures of third-party systems, payment gateways, telecom providers, or internet services
• any other event beyond the reasonable control of the Company
During the continuance of any Force Majeure event, the Company’s obligations shall remain suspended to the extent affected by such event, and the Company shall not be responsible for any loss, damage, inconvenience, or service disruption resulting therefrom.
21.1 Service Availability
The Company does not guarantee that the Platform or any part of its services will be available at all times or without interruption.
Access to and use of the Platform may be temporarily limited, suspended, or affected due to reasons including:
• scheduled maintenance or upgrades
• emergency maintenance activities
• network or connectivity failures
• software bugs, system errors, or technical malfunctions
• third-party service interruptions
• Force Majeure events or other circumstances beyond the Company’s reasonable control
The Company shall not be liable for any loss, delay, inconvenience, or damage arising from temporary unavailability, interruption, or degradation of the Platform or its services.
21.2 Platform Administration and Operational Rights
To ensure the efficient functioning, safety, and integrity of the Platform, Modi Enterprises, the operator of the Namma Electric Platform, reserves the right to exercise certain administrative and operational controls.
These rights may be exercised when reasonably required to maintain service quality, user safety, and compliance with applicable laws.
The Company may, at its discretion:
• modify or update Platform features, functionalities, or services
• introduce, update, or remove service offerings available through the Platform
• change or adjust fare structures, service fees, subscription charges, or other applicable pricing components
• temporarily suspend services for maintenance, upgrades, or operational improvements
• investigate complaints, disputes, or suspicious activities related to Platform usage
• monitor ride activity, transactions, and platform interactions for safety and fraud prevention purposes
• restrict, suspend, or deactivate user or driver accounts that violate Platform policies or Terms and Conditions
• remove drivers or users from the Platform in cases involving misconduct, fraudulent activity, safety concerns, or repeated policy violations
Such actions may be taken where necessary to protect the integrity of the Platform, its users, driver partners, and the Company.
22. Changes to Terms
Modi Enterprises reserves the right to amend, revise, update, or modify these Terms and Conditions at any time, at its sole discretion, in order to reflect changes in applicable law, business operations, platform features, services, policies, or regulatory requirements.
Any revised version of these Terms shall be published on the Namma Electric Platform and shall become effective immediately upon publication, unless otherwise expressly stated.
Users are encouraged to review these Terms periodically to remain informed of any updates.
By continuing to access or use the Platform after revised Terms have been published, users acknowledge and agree to be bound by such updated Terms.
These Terms and Conditions constitute the entire agreement between the user and Modi Enterprises with respect to the use of the Namma Electric Platform and supersede all prior or contemporaneous agreements, communications, representations, or understandings, whether oral or written, relating to the same subject matter.
23. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
Any dispute, claim, or controversy arising out of or in connection with these Terms, the Platform, or the services facilitated through the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka.
